Oregon man sentenced to prison for shooting, killing neighbor’s labrador

A Newport, Oregon, man will serve prison time for killing his neighbor’s 6-year-old black lab, a Lincoln County Circuit Court judge ordered Friday.

Tyson Kay, 47, was arrested on July 5, 2024, after his neighbor told police he shot her dog, Daisy. A probable cause document says Kay told police that Daisy had been coming onto his property, eating food and damaging things. He told police he shot her in the back with a less lethal round.

But prosecutors alleged that Kay shot Daisy with birdshot. Daisy’s owners found her “injured, wet and panting heavily,” the Lincoln County District Attorney’s Office said in a news release.

Kay argued at trial that he was trying to protect baby chicks living on his property, according to the DA. Prosecutors alleged that contradicted what he told police. A probable cause document says Kay told police at the time that he shot the dog after he heard her going through his trash.



Police documents say Daisy had a collapsed lung and had to be euthanized.

A jury last month found Kay guilty of two counts of animal abuse. Judge Amanda Benjamin sentenced Kay to 18 months in prison and 24 months of additional supervision, the news release said.
