Bail has been set at $150,000 for the Chehalis man accused of pinning a woman down in her bed while licking her face after a New Year’s Eve party, then jumping the curb in his car in front of police.
The defendant, John M. Gallivan, 40, was reportedly invited to the alleged victim’s apartment on Scammon Creek Road with a group of people for a New Year’s Eve party on Dec. 31, according to documents filed in Lewis County Superior Court. The victim reported that the group was drinking and said she went to bed in her bedroom shortly after midnight on Jan. 1.
The victim reported waking to “Gallivan licking the side of her face, straddling her with his legs punched against her hips on either side with his hands on (the victim’s) shoulders, pinning her to the bed,” according to court documents.
Gallivan is accused of “dry humping” the victim and licking her two more times after she woke up, according to court documents.
Gallivan then reportedly left the residence and went to retrieve his truck from the 220 block of Tower Avenue.
While he was gone, the victim contacted law enforcement.
Officers with the Centralia Police Department contacted Gallivan in downtown Centralia, where he was driving his vehicle.
“Gallivan reportedly jumped the curb in his car as he approached law enforcement, and law enforcement had to pound on the hood of Gallivan’s vehicle to get him to stop,” according to court documents.
Gallivan allegedly admitted “to drinking ‘too much’” when he was contacted by law enforcement.
He reportedly consented to standardized field sobriety tests, where he exhibited all but two out of the 16 total clues for impairment over the series of four tests. Law enforcement also noted Gaillvan had “bloodshot watery eyes” when they contacted him, according to court documents.
Gallivan was arrested in the 1000 block of Scammon Creek Road at approximately 3:40 a.m. on Jan. 1 and was booked into the Lewis County Jail at 7:15 a.m. that morning.
He has since been charged with one count of indecent liberties — a class A felony with a maximum penalty of life in prison — and one count of driving under the influence.
Due to the severity of the allegation and concerns about Gallivan’s criminal history — which includes a 2007 conviction for second-degree child molestation, a 2011 conviction for failure to register as a sex offender and a recently-completed DUI case out of Napavine — Judge James Lawler said the current case required “some substantial bail” and set the bail amount at $150,000.
Gallivan’s arraignment hearing is scheduled for Thursday, Jan. 3.
