Lewis County man charged with failing to register as sex offender

A Silver Creek man and Level 3 sex offender was arrested Tuesday after he allegedly failed to check in at the Lewis County Sheriff’s Office as required.  

Kenneth Emory Allen, 33, had previously registered as a transient sex offender on Jan. 8.  

Allen now faces up to five years in prison for one count of failure to register as a sex offender. He made a preliminary appearance in Lewis County Superior Court on Wednesday.

A judge set bail at $15,000 cash or bond and scheduled an arraignment for Thursday. 

According to a probable cause affidavit, Allen failed to arrive at the sheriff's office on Aug. 10. The following day, Allen allegedly called the detective in charge of monitoring sex offender registration and left a voicemail saying he had been in the hospital. 

Allen arrived at the sheriff’s office and spoke to the detective. He again said he had been in the hospital, and said he’d noted it in his weekly transient log, according to the affidavit. 



The detective reportedly requested paperwork due by the end of the week confirming the times Allen was admitted to the hospital and discharged. 

Otherwise, the detective would investigate. 

According to the affidavit, Allen then admitted to lying, and allegedly said he’d fallen asleep and “did not wake up until after registration hours.”

The detective arrested Allen.

According to court records, Allen has prior adult convictions for indecent exposure, second-degree possession of depictions of minors engaged in sexually explicit conduct and failure to register as a sex offender, along with other minor convictions.
