A woman who phoned 911 to report that her 3-year-old daughter was face-down in a kiddie pool at their Albany home Sunday was charged Monday with attempted aggravated murder.

Authorities became suspicious of Kristen Rae Brooks, 30, after she called 911, reported that her daughter was in distress in the shallow water and was instructed by an operator to pull the girl out of the water, which she did, said Albany police spokesperson Laura Hawkins. First responders arrived, discovered the child wasn’t breathing and began CPR.

The girl was still in critical condition Monday at a Portland-area hospital, police said.

Police are investigating the suspicious circumstances – including the possibility that the mother’s mental health may be a factor in the incident.

Brooks was booked into Linn County Jail at 10:24 p.m. Sunday. She was arraigned on charges of attempted aggravated murder and first-degree criminal mistreatment Monday in Linn County Circuit Court.

Police ask anyone with information to call their detective unit at 541-917-7686 and reference case #23-06719.
